As a Black homeless man, Keely was particularly vulnerable to this kind of suspicion. As much as the incident itself, the reaction to his death speaks to the way that homeless people have been dehumanised in the US that Neely was Black is also surely more than incidental. In the years since the pandemic, major American cities like New York, Los Angeles and San Francisco have been the sites of moral panics about homelessness, mental illness and addiction.

Who is Penny? Penny graduated from high school in West Islip, NY. He surrendered to authorities 11 days after he placed Neely in a fatal chokehold on an F train. The NYPD tackled several protestors to the ground to execute arrests.
Mr Penny pinned Mr Neely to the floor of the subway carriage with the help of two other passengers and held him in a chokehold. Police questioned Mr Penny, who is white, in the aftermath but released him without charges.
Mr Neely was black. He did not hit anyone. But he was choked to death. Mr Neely, remembered by some commuters for his Michael Jackson impersonations, had been dealing with homelessness and mental illness in recent years, friends said. Mr Neely had been arrested multiple times and had recently pleaded guilty for assaulting a 67-year-old woman leaving a subway station in 2021.
